Can I get an urgent protection order?

Urgent interim protection may be available where the statutory requirements are met. The application should explain the recent conduct, the present risk and why waiting for the ordinary process would leave the applicant without effective protection.

  • Give exact dates for the most recent incidents.
  • Explain the present risk rather than merely calling the matter urgent.
  • Attach only evidence that helps the magistrate understand the risk quickly.
  • An interim order is temporary and the matter still proceeds further.

What the court needs to understand

The papers should make the relationship, recent conduct, feared harm and protection requested immediately understandable. Distinguish what has already happened from what you fear may happen next.

After interim protection is granted

The order and application must be served in the prescribed manner and the respondent is given the opportunity to respond. The interim stage is therefore protection pending the later determination, not the end of the case.
