How to write a protection order affidavit
A useful protection-order affidavit is a factual, dated account that allows the magistrate to understand what happened, why protection is required and exactly what order is sought. It should describe conduct rather than rely on labels and should link important documents to the allegation they support.
- Start with the relationship and relevant background.
- Use numbered paragraphs and a chronological sequence.
- Describe what was said or done instead of simply alleging abuse or harassment.
- State the exact terms you want the court to order.
A practical structure
Use a short introduction, necessary background, chronological incidents, the most recent escalation or risk, the impact of the conduct and the specific relief requested. Keep each paragraph focused on one factual point.
Use annexures deliberately
Do not turn the affidavit into an unexplained screenshot dump. Identify each important document, say what it proves and place it with the allegation to which it relates.
