Check the wording of the order
A breach starts with the terms actually contained in the operative order. Identify the exact prohibition or obligation said to have been contravened.
Get to safety if there is immediate danger
Do not delay emergency assistance merely to assemble evidence. Contact SAPS where there is an immediate threat.
Preserve proof of the incident
Keep messages, calls, photographs, video, witness details and a short note of what happened, when and where.
Report the alleged contravention
Take the protection order and the prescribed warrant or related documentation available to you to SAPS and explain which term was breached.
Keep the reporting details
Record the station, date, time, reference numbers and any further incidents separately.
Warrant and arrest
Can a respondent be arrested for a breach?
Yes, the protection-order framework provides a warrant-and-complaint mechanism. Whether arrest follows depends on the applicable legislation, the order, the alleged contravention and the statutory requirements.
For the complainant
Take the order, available prescribed documents and supporting proof to SAPS. Explain the alleged contravention by reference to the wording of the order.
For the respondent
Do not assume the underlying protection-order dispute answers a breach allegation. Preserve evidence relevant to the incident and obtain advice on any related criminal process.
